Citizen participation in local governance in Albania: A legal and institutional analysis
By Ilir BARJABA
Abstract
Citizen participation is a central element of democratic governance, particularly at the local level. In Albania, the legal framework governing local self-government provides for a range of participatory mechanisms, including local elections, public
consultations, referenda, civic initiatives, and access to information. However, the effectiveness of these mechanisms remains disputed. This article examines the extent to which the Albanian legal framework enables effective citizen participation through electoral and non-electoral mechanisms. It employs doctrinal legal analysis, comparative analysis with European standards, and qualitative institutional assessment, focusing on the Constitution of Albania, Law No. 139/2015 On Local Self-Government, Law No. 146/2014 On Notification and Public Consultation, the Electoral Code, the European Charter of Local Self-Government, and selected European legal practices. The analysis finds that Albania has largely aligned its legal framework with European standards, but implementation remains uneven. The closed-list proportional electoral system for municipal councils weakens
electoral accountability, while public consultations and local referenda have limited practical influence on municipal decision-making. Although gender quotas have substantially increased women’s representation in municipal councils, women remain underrepresented in mayoral office. The article provides an integrated legal assessment of citizen participation in local self-government and proposes reforms to strengthen electoral accountability, enhance the effectiveness of participatory mechanisms, improve the implementation of gender equality provisions, and further align Albanian law with European standards of local self-government.
